{"id":90,"date":"2025-06-18T17:53:11","date_gmt":"2025-06-18T17:53:11","guid":{"rendered":"https:\/\/vallartadaily.com\/es\/?p=90"},"modified":"2025-06-18T17:53:12","modified_gmt":"2025-06-18T17:53:12","slug":"nueva-ley-laboral-en-mexico-protege-a-repartidores-y-choferes-de-apps-desde-el-22-de-junio","status":"publish","type":"post","link":"https:\/\/vallartadaily.com\/es\/noticias\/nueva-ley-laboral-en-mexico-protege-a-repartidores-y-choferes-de-apps-desde-el-22-de-junio\/","title":{"rendered":"Nueva ley laboral en M\u00e9xico protege a repartidores y choferes de apps desde el 22 de junio"},"content":{"rendered":"\n<p><strong>Nueva ley laboral en M\u00e9xico otorga derechos a m\u00e1s de 500,000 repartidores y choferes de Uber, Rappi y DiDi<\/strong><\/p>\n\n\n\n<p>A partir del <strong>22 de junio de 2025<\/strong>, entra en vigor en M\u00e9xico una reforma hist\u00f3rica que reconoce los <strong>derechos laborales de los trabajadores de plataformas digitales<\/strong> como Uber, DiDi, Rappi y otras apps de movilidad y reparto.<\/p>\n\n\n\n<p>La medida impacta directamente a m\u00e1s de <strong>500,000 personas<\/strong> que hasta ahora laboraban <strong>sin prestaciones, seguridad social ni protecci\u00f3n contra despidos<\/strong>.<\/p>\n\n\n\n<p>La reforma, publicada en el <strong>Diario Oficial de la Federaci\u00f3n (DOF)<\/strong> el <strong>24 de diciembre de 2024<\/strong>, modifica la <strong>Ley Federal del Trabajo<\/strong> para establecer una nueva regulaci\u00f3n que obliga a las plataformas digitales a otorgar <strong>seguridad social, vacaciones pagadas, aguinaldo y otros beneficios<\/strong> a sus trabajadores.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfA qui\u00e9nes aplica esta nueva ley?<\/h3>\n\n\n\n<p>La ley protege a todo repartidor o conductor que cumpla <strong>al menos una<\/strong> de estas dos condiciones:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trabajar <strong>80 horas o m\u00e1s al mes<\/strong> conectado a la aplicaci\u00f3n.<\/li>\n\n\n\n<li>Generar <strong>ingresos iguales o superiores al salario m\u00ednimo mensual<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Si cumples con cualquiera de estos requisitos, la plataforma est\u00e1 <strong>obligada legalmente<\/strong> a reconocerte como trabajador subordinado, con acceso completo a tus derechos laborales.<\/p>\n\n\n\n<p>Importante: Aunque no cumplas con estas condiciones m\u00ednimas, si est\u00e1s activo en la app, <strong>IMSS debe cubrirte con un seguro contra riesgos de trabajo<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfQu\u00e9 beneficios recibir\u00e9 como repartidor o conductor?<\/h3>\n\n\n\n<p>A partir del 22 de junio, si cumples con los criterios establecidos, la plataforma debe brindarte:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Registro en el IMSS<\/h4>\n\n\n\n<p>Tendr\u00e1s acceso a:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Atenci\u00f3n m\u00e9dica p\u00fablica.<\/li>\n\n\n\n<li>Incapacidades laborales.<\/li>\n\n\n\n<li>Pensiones por invalidez o vejez.<\/li>\n\n\n\n<li>Seguro de accidentes mientras trabajas.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Aportaciones al Infonavit<\/h4>\n\n\n\n<p>Las plataformas deber\u00e1n hacer las <strong>aportaciones patronales<\/strong> necesarias para que puedas <strong>acceder a cr\u00e9ditos de vivienda<\/strong>, ya sea para comprar, construir o mejorar una propiedad.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Aguinaldo y vacaciones<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recibir\u00e1s un <strong>aguinaldo anual obligatorio<\/strong>.<\/li>\n\n\n\n<li>Tendr\u00e1s <strong>vacaciones pagadas<\/strong>, de acuerdo a tu antig\u00fcedad.<\/li>\n\n\n\n<li>Gozar\u00e1s de <strong>un d\u00eda de descanso por cada seis trabajados<\/strong>, sin excepci\u00f3n.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Reparto de utilidades (PTU)<\/h4>\n\n\n\n<p>Si trabajas <strong>m\u00e1s de 288 horas al a\u00f1o<\/strong> en la plataforma, tendr\u00e1s derecho a recibir <strong>una parte proporcional de las utilidades<\/strong> de la empresa.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Indemnizaci\u00f3n por despido<\/h4>\n\n\n\n<p>Si te despiden sin justificaci\u00f3n, la empresa deber\u00e1 pagarte:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Tres meses de salario<\/strong> como indemnizaci\u00f3n.<\/li>\n\n\n\n<li><strong>20 d\u00edas por cada a\u00f1o trabajado<\/strong>.<\/li>\n\n\n\n<li>Prestaciones proporcionales no cubiertas.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfSeguir\u00e9 siendo independiente como repartidor?<\/h3>\n\n\n\n<p>S\u00ed. La nueva ley <strong>no impone horarios fijos<\/strong>. Puedes seguir decidiendo <strong>cu\u00e1ndo conectarte y cu\u00e1ndo no<\/strong>, sin que la plataforma te penalice por estar inactivo.<\/p>\n\n\n\n<p>El trabajo contin\u00faa siendo flexible, pero si cumples con los criterios establecidos, <strong>debes recibir todos los derechos que tendr\u00eda un trabajador formal<\/strong>. El l\u00edmite m\u00e1ximo de jornada es de <strong>48 horas semanales<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfQu\u00e9 deben hacer las plataformas como Uber y Rappi?<\/h3>\n\n\n\n<p>Las empresas deber\u00e1n:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Registrar a sus trabajadores activos en <strong>IMSS<\/strong> e <strong>Infonavit<\/strong>.<\/li>\n\n\n\n<li>Firmar <strong>contratos escritos<\/strong> que reconozcan la relaci\u00f3n laboral.<\/li>\n\n\n\n<li>Reportar <strong>ingresos semanales, propinas y horas trabajadas<\/strong>.<\/li>\n\n\n\n<li>Explicar con claridad c\u00f3mo funcionan <strong>sus algoritmos, comisiones y tarifas<\/strong>.<\/li>\n\n\n\n<li>No podr\u00e1n cobrar por registrarse ni retener pagos sin motivo.<\/li>\n<\/ul>\n\n\n\n<p>Estas obligaciones estar\u00e1n sujetas a vigilancia por parte de la <strong>Secretar\u00eda del Trabajo y Previsi\u00f3n Social<\/strong>, el <strong>IMSS<\/strong> y el <strong>Infonavit<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfCambiar\u00e1 mi situaci\u00f3n fiscal?<\/h3>\n\n\n\n<p>No. <strong>No aumentar\u00e1 tu carga fiscal<\/strong>. Desde la implementaci\u00f3n del r\u00e9gimen fiscal para plataformas digitales, empresas como Uber, DiDi y Rappi ya <strong>retienen autom\u00e1ticamente el IVA y el ISR<\/strong> correspondiente.<\/p>\n\n\n\n<p>Si tus ingresos no rebasan el l\u00edmite establecido por el <strong>SAT<\/strong>, <strong>no tendr\u00e1s que presentar declaraciones adicionales<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fechas clave<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>24 de diciembre de 2024<\/strong>: Publicaci\u00f3n en el DOF.<\/li>\n\n\n\n<li><strong>22 de junio de 2025<\/strong>: Entrada en vigor de la reforma.<\/li>\n\n\n\n<li><strong>27 de junio de 2025<\/strong>: IMSS publicar\u00e1 las reglas operativas para la afiliaci\u00f3n de trabajadores de plataformas.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Un antes y un despu\u00e9s para los trabajadores de apps<\/h3>\n\n\n\n<p>Por primera vez en M\u00e9xico, quienes <strong>reparten comida, trasladan pasajeros o entregan productos a trav\u00e9s de aplicaciones<\/strong> tecnol\u00f3gicas tendr\u00e1n <strong>derechos laborales garantizados<\/strong>, incluyendo acceso a <strong>IMSS, vacaciones, aguinaldo y vivienda<\/strong>, <strong>sin perder la flexibilidad<\/strong> que caracteriza este tipo de trabajo.<\/p>\n\n\n\n<p>La reforma marca un parteaguas en la econom\u00eda digital mexicana, y representa <strong>un paso clave hacia la protecci\u00f3n laboral en la era de las
